Loveland Considers Suing County
Council To Decide Tuesday

The City of Loveland will decide whether to take formal legal action against Larimer County during a closed door
"Executive Session" at a special meeting of the council Tuesday night (June 9, 2009).

The agenda item for the closed door portion of the city meeting is listed on the council public agenda only as;

"EXECUTIVE SESSION REGARDING CITY FEES AND TAXES AT THE RANCH"

LovelandPolitics has learned the City of Loveland is accusing Larimer County of not complying with an agreement
regarding certain development fees.  Loveland City Attorney John Duval believes Larimer County is in breach of their
agreement with the City of Loveland over the county's new fairgrounds near the I-25 and Crossroads Blvd. called The
Ranch.

According to sources familiar with the issue, at least one member of the Loveland City Council is aggressively pushing to
cease negotiations with Larimer County on the unpaid fees and take the issue to court.  Some in the County speculate any
litigation being threatened is "payback" for Larimer County failing to suppport McWhinney's proposed abandonment of its
obligation to improve the I-25 and U.S. 34 interchange.  Many in the City of Ft. Collins and Larimer County governments
see the Loveland City Council as partisans for McWhinney who place that developer's interest ahead of the city's interests.

The dispute appears largely a disaggreement over what fees or taxes the county is obligated to pay for The Ranch.  It was
was originally scheduled to be decided during the council's June 2, 2009 regularly scheduled council meeting but was
postponed along with a McWhinney request to reduce capital expansion fees for the specially scheduled meeting this
Tuesday.
